Dog Bites

Under Florida law, the owner of a dog that injures another person is strictly liable (automatically) for the victims injuries. The injuries often occur in the form of bites, or orthopedic injuries from a person being knocked down by a dog. It is not necessary for the victim to prove that the dog had prior dangerous propensities.
Dog bite cases can be devastating, particularly with children.
One of the problems with dog bite cases is that sometimes the owner does not have any insurance to indemnify them for injuries caused by their dog. Homeowners insurance often does provide compensation if the insured's dog causes injury. However, some homeowners policies exclude dog bites or exclude certain types of dogs from coverage such as Rottweiler. One of the critical issues in these cases is identifying the owner of the dog and determining whether they have any homeowner insurance coverage for their animal.
