Motorcycle Accidents

Some attorneys hold themselves out as specialists in motorcycle accidents. Truthfully, there is no such thing. Every lawyer who practices personal injury law also handles motorcycle accident cases. There is no sub specialty of motorcycle accidents.
With that being said, motorcycle accidents do present issues that are different in automobile accident cases.
First, the Florida no-fault law does not apply to motorcycles in that under Florida law a motorcycle does not meet the definition of a motor vehicle. Hence, the owner of a motorcycle cannot purchase no-fault insurance to protect them in case they are injured in an automobile accident. For this reason, it is critical that owners of motorcycles purchase uninsured motorist protection.
Since many motorcycle accident cases result in serious injury, it is also highly recommended that motorcycle owners also have health insurance.
Since the Florida no-fault law does not apply to motorcycle riders, it is not necessary for a motorcyclist that they have suffered a permanent injury in order to recover damages for pain, suffering, mental anguish, and inconvenience against the person who caused their accident. Therefore, it is often easier for motorcyclists who are injured in an accident to recover a satisfactory settlement.
In addition, motorcyclist rarely are found at fault for an accident. Usually, it is someone else who is completely at fault for causing the accident.
Even though a helmet is not required in the state of Florida, a defendant in a motorcycle accident case will often claim that the Plaintiff's injuries could have been minimized or eliminated if the motorcyclist had been wearing a helmet. This is another good reason why motorcyclists should always wear a helmet.
I have personally prosecuted motorcycle serious injury and death cases. I myself am a motorcycle enthusiast. As you can tell from my summary of this subsection, I wear a helmet when I ride.
